Preamble

These Privacy Policies form an integral part of the General Terms and Conditions (as defined below) and the definitions used in the General Terms and Conditions are reused in these Privacy Policies.

The purpose of this Privacy Policy is to inform Data Subjects of the manner in which their Personal Data is collected from the Site, how such Personal Data is processed by Cilanda and finally the Specific Rights (as defined below) that Data Subjects enjoy in relation to such processing as defined below.

Definitions

The following terms, whether used in the singular or plural in these Confidentiality Policies, shall have the following definition:

Intermediate archiving :

means the transfer of Personal Data which is still of administrative interest to Cilanda (for example, in the event of litigation and/or in the event of a legal obligation) to a separate database, logically or physically separate and, in any event, to which access is restricted. This archive is an intermediate step before the Personal Data concerned is deleted or made anonymous;

Privacy policy :

means this privacy and data protection policy implemented by Cilanda, which forms an integral part of the General Terms and Conditions;

General Terms and Conditions refers indiscriminately to: General Terms and Conditions of Use, General Terms and Conditions of Service and General Terms and Conditions of Sale.

Personal data :

means the personal data of the Data Subject, within the meaning of the Regulation on Personal Data, collected and processed by Cilanda in connection with the use of the Site;

Specific rights :

means the rights granted by the Personal Data Regulations to Data Subjects concerning the processing of their Personal Data and detailed in Article IX ;

Person concerned :

refers to the natural person (Internet user, Customer, Subscriber) whose Personal Data is processed by Cilanda ;

Regulation on Personal Data:

means Law no. 78-17 of 6 January 1978 relating to data processing, data files and individual liberties, in application of the General Data Protection Regulation;

Cilanda:

refers to the company e-comeo OÜ, whose registered office is located at Lõõtsa tn 2a, 11415 Tallinn, Estonia, registered under the number 16563515.

Terminal(s) :

means the hardware equipment (computer, tablet, smartphone, telephone, etc.) used by the Person Concerned to consult or view the Site and/or any other digital medium published by a third party.

Legal basis for processing

In accordance with the Personal Data Regulations, the processing operations referred to in these Privacy Policies are supported by a specific legal basis.

The Data Subject has consented to the processing of his/her Personal Data for one or more specific purposes.

The Site may have required the express consent of the Data Subject in order to carry out a specific processing operation explained at the time of obtaining consent.

The processing is necessary for the performance of a contract to which the Data Subject is a party or for the performance of pre-contractual measures taken at the Data Subject's request.

In order to use the Site and benefit from its services, the Data Subject has accepted at least the General Terms and Conditions of Use and, where applicable, the General Terms and Conditions of Sale and/or the General Terms and Conditions of Service. These documents formalise a contractual relationship between the Data Subject and Cilanda, serving in particular as the legal basis for the collection and processing of the Data Subject's Personal Data by Cilanda.

This Data is necessary for the performance of a certain number of processing operations linked to the execution of the contractual relationship between the Data Subject and Cilanda, the purposes of which are detailed in the paragraph entitled "The purposes of the processing operations".

The processing is necessary to comply with a legal obligation to which it is subject.

The processing of Personal Data may also be necessary to comply with a legal obligation to which Cilanda is subject, for example, the storage of logs of access to the Site, in accordance with Decree No. 2011-219 of 25 February 2011 on the storage and communication of data identifying any person having contributed to the creation of content placed online.

The processing is necessary for the purposes of the legitimate interests pursued by Cilanda or by a third party, unless the interests or the fundamental rights and freedoms of the Data Subject require the protection of personal data, in particular when the Data Subject is a child.

Cilanda may have a legitimate interest justifying the processing of the Data Subject's Personal Data, such as the processing of Data strictly necessary for fraud prevention purposes.

In such a case, Cilanda shall ensure that the processing in question is necessary to achieve its legitimate interest and shall assess the consequences of such processing for the Data Subject, in particular by taking into account the nature of the Data processed and the way in which they are processed.

Cilanda ensures that it does not disregard the interest or fundamental rights and freedoms by allowing the Data Subject, at any time, to object to all or part of the processing described in these Confidentiality Policies, as well as to exercise his or her Specific Rights, under the conditions set out in the paragraph entitled "Specific Rights".

Purposes of processing

The Data Subject's Personal Data is necessary to enable him or her to access, use and improve the Site, and to enable Cilanda to :

• Carry out operations relating to its commercial relationship with the Data Subject, i.e. invoicing, accounting, monitoring the "customer relationship" with a Customer or Subscriber, such as carrying out satisfaction surveys, managing complaints, using the Site and more generally services, etc... ;
• To select Customers or Subscribers in order to carry out studies, surveys and product tests, as well as loyalty, canvassing and promotional campaigns;
• To personalise its communications to Customers or Subscribers, in particular by means of information e-mails, according to their preferences and use of the Site;
• To carry out canvassing operations, i.e. the management of technical canvassing operations (including technical operations such as standardisation, enrichment and de-duplication);
• Carrying out commercial solicitation operations;
• Drawing up commercial statistics, analyses and marketing tools (including classification, scoring, etc.).
• The organisation of competitions, lotteries or any promotional operation, with the exception of online gambling and games of chance subject to approval by the "Autorité de Régulation des Jeux en Ligne";
• The management of requests to exercise Specific Rights under the conditions set out in the paragraph entitled "Specific Rights";
• Management of unpaid and disputed amounts;
• The management of comments made by Concerned Parties on the Site and/or on internet pages published by Cilanda such as social network pages;
• Combating fraud.

Storage of Personal Data

The Site is hosted by the company whose contact details are available in the General Terms and Conditions of Use, accessible from the footer of the site.

Every precaution has been taken to store the Personal Data of Data Subjects in a secure environment and prevent it from being distorted, damaged or accessed by unauthorised third parties. The information transmitted by the Data Subject will never be transmitted to third parties for commercial purposes, nor will it be sold or exchanged, except with the Data Subject's express prior consent.

Collection of Personal Data on the Site

Cilanda collects the following Personal Data that Customers and Subscribers fill in and communicate when browsing the Site. This data is kept for a period of three (3) years, on an active basis, from the date of the last connection of the Person Concerned to the Site:

• Gender,
• Date of birth,
• e-mail address,
• Username used on the Site,
• Payment identifier,
• Delivery address,
• Invoice address,
• Telephone number,

Connection data (date, time, IP address, pages consulted) of the Person Concerned when browsing the Site and, in particular, data relating to the use of Specific Services by the Subscriber,

The data entered by the Subscriber on the Site when using the Specific Services,

If applicable, the reason(s) for the exclusion (all the information needed to demonstrate the behaviour, which is less than one month old and justifies the exclusion),

The above Personal Data is also kept in Intermediate Storage for a further period of two (2) years in accordance with the common limitation period.

• Invoices,
• Amount of transactions carried out as well as the date and time of these transactions,

The above Personal Data is also kept in Intermediate Storage for a further period of seven (7) years, in accordance with Cilanda's tax and accounting obligations.

Only the Personal Data designated as compulsory on the Site is required to have an Account.

Addressees or categories of addressee, if any

Cilanda may communicate to third parties certain Personal Data which are necessary for the completion of Orders under the General Terms and Conditions of Sale or Subscriptions under the General Terms and Conditions of Service, in order to ensure in particular:

• shipment of Products;
• the fight against fraud,
• after-sales service, etc.

Internet transaction security

In accordance with the General Terms and Conditions, the Site uses the technology of various PSP (Payment Service Provider) companies to secure the banking transactions of Customers and Subscribers.

Thus, when payment is made on the Site, the bank details of the Person Concerned are transmitted encrypted to the company processing the payment, without Cilanda being able to see them.

Cilanda does not collect the full number of the Customer's bank card or the Subscription, nor its cryptogram.

To exercise their rights, such as those identified in the "Specific Rights" paragraph, relating to their bank card details, the Data Subject is invited to contact the company that processed the payment directly. Specific Rights

In accordance with the Personal Data Regulations, the Data Subject may, at any time, benefit from the following Specific Rights of/to :

• access,
• rectification,
• deletion,
• limitation of processing,
• portability,
• opposition,
• post-mortem directives.

Access rights

The Data Subject may obtain from Cilanda confirmation as to whether or not Personal Data concerning him or her is being processed and, where it is being processed, access to such Personal Data and the following information:

• the purposes of the processing ;
• the categories of Personal Data;
• the recipients or categories of recipients to whom the Personal Data has been or will be disclosed;
• where possible, the intended retention period for the Personal Data or, where this is not possible, the criteria used to determine this period;
• the existence of the right to ask Cilanda to rectify or erase Personal Data, or to restrict the processing of Personal Data, or the right to object to such processing;
• the right to lodge a complaint with the CNIL;
  where Personal Data is not collected from the Data Subject, any available information as to its source;
• the existence of automated decision-making, including profiling, and, at least in such cases, useful information concerning the underlying logic, as well as the importance and the anticipated consequences of this processing for the Data Subject.

Where Personal Data is transferred to a third country or to an international organisation, the Data Subject has the right to be informed of the appropriate safeguards with respect to such transfer.

Cilanda provides a copy of the Personal Data being processed.

Cilanda may charge a reasonable fee based on administrative costs for any additional copies requested by the Data Subject.

Where the Data Subject submits his or her request electronically, the information shall be provided in a commonly used electronic form, unless he or she requests otherwise.

The Data Subject's right to obtain a copy of his or her Personal Data shall not prejudice the rights and freedoms of others.

Rights of rectification

The Data Subject may obtain from Cilanda, as soon as possible, the rectification of any Personal Data concerning him or her that is inaccurate. He or she may also request that incomplete Personal Data be completed, including by providing an additional declaration.

Erasure rights

The Data Subject has the right to obtain from Cilanda the erasure, as soon as possible, of Personal Data concerning him or her where one of the following reasons applies:

• the Personal Data is no longer necessary for the purposes for which it was collected or otherwise processed by Cilanda;
• the Data Subject has withdrawn his/her consent to the processing of such Personal Data and there is no other legal basis for the processing;
• the Data Subject exercises his/her right to object under the conditions set out below and there is no compelling legitimate reason for the processing;
• the Personal Data has been processed unlawfully;
• the Personal Data must be deleted to comply with a legal obligation;
• the Personal Data has been collected from a child.

Limitation rights

The Person Concerned has the possibility of obtaining from Cilanda the limitation of the processing of his/her Personal Data when one of the following reasons applies:

• Cilanda verifies the accuracy of the Personal Data following a challenge by the Data Subject to the accuracy of the Personal Data;
• The processing is unlawful and the Data Subject objects to the erasure of the Personal Data and instead requests that its use be restricted;
• Cilanda no longer needs the Personal Data for the purposes of the processing, but it is still necessary for the Data Subject to establish, exercise or defend legal claims;
• The Data Subject has objected to the processing under the conditions set out below and Cilanda shall verify whether the legitimate grounds pursued prevail over the alleged grounds.

Right to data portability

The Person Concerned has the possibility of receiving from Cilanda Personal Data concerning him or her, in a structured, commonly used and machine-readable format when:

• The processing of Personal Data is based on consent or on a contract. And,
• Treatment is carried out using automated processes.

When the Data Subject exercises his or her right to portability, he or she has the right to obtain that the Personal Data be transmitted directly by Cilanda to another controller that it will designate when this is technically possible.

Right to object

The Data Subject may object at any time, on grounds relating to his or her particular situation, to the processing of his or her Personal Data based on the legitimate interests of Cilanda. The latter will then no longer process the Personal Data, unless it can demonstrate that there are compelling legitimate grounds for the processing which override the interests and rights and freedoms of the Data Subject, or may retain them for the establishment, exercise or defence of legal claims.

Likewise, we remind you that, if the Data Subject has provided a telephone number, he or she has the right to register on a telephone anti-solicitation list.

Post-mortem instructions

The Data Subject has the possibility of communicating to Cilanda directives relating to the conservation, deletion and communication of his/her Personal Data after his/her death, which directives may also be registered with a "certified trusted digital third party". These directives, or a sort of "digital will", may designate a person to be responsible for their execution; failing this, the heirs of the Data Subject will be designated.

In the absence of any directive, the heirs of the Person Concerned may contact Cilanda in order to :

• access Personal Data processing enabling "the organisation and settlement of the deceased's estate";
• to receive communication of "digital assets" or "data similar to family souvenirs, which may be passed on to heirs";
• to close the Data Subject's account on the Site and to oppose the continued processing of his/her Personal Data.In any event, the Data Subject has the possibility to indicate to Cilanda, at any time, that he/she does not wish his/her Personal Data to be communicated to a third party in the event of his/her death.

Exercising Users' Specific Rights

These rights may be exercised at any time by contacting Cilanda :

For the purposes of enforcing its rights under the conditions set out above and in the event that Cilanda has doubts about the person making the request, Cilanda may ask that person to provide proof of his or her identity by mentioning his or her surname, first name and e-mail address and to accompany the request with a copy of a valid form of identification.

A reply will be sent to the Person Concerned within a maximum of one (1) month following the date of receipt of the request.

If necessary, this period may be extended by two (2) months by Cilanda, which will notify the Person Concerned, taking into account the complexity and/or number of requests.

Should the Data Subject request the deletion of his or her Personal Data and/or exercise his or her right to request the deletion of his or her Personal Data, Cilanda may nevertheless retain them in the form of Intermediate Archiving, for the period necessary to meet its legal obligations, or for evidentiary purposes during the applicable limitation period.

The Data Subject may also lodge a complaint with the competent supervisory authority (the CNIL).

The security of your password

Cilanda takes every precaution to ensure the secure storage of the Data Subject's password.

However, the security of this password also depends on its design.

The Person Concerned is therefore reminded that, to be valid, his/her password must consist of at least 8 characters, including at least 3 of the following 4 types: upper case, lower case, numbers, special characters, etc.

There are mnemonics for creating complex passwords, such as :

• Keeping only the first letters of words in a sentence; for example, the sentence "Remember your password" corresponds to the password 1mdp@sr!
• By capitalising the word if it is a noun (e.g.: word)
• Use punctuation marks (e.g. !)
• Expressing numbers using digits from 0 to 9 (e.g. Un ->1)

Cookies deposited on the Terminal of the Person Concerned following their browsing on the Site

Cookies are used on the Site.

A cookie is a piece of information deposited on the Terminal used by the Person Concerned to access the Site.

Cookies are related to the Person Concerned's browsing on the Site and make it possible to determine which pages he/she has consulted and the date and time of consultation.

At no time do these cookies enable Cilanda to identify the Data Subject personally.

These cookies are kept on the Terminal of the Person Concerned for no longer than thirteen (13) months.

More specifically, Personal Data collected from cookies issued by Cilanda or third parties is used to:

• To compile statistics and volumes of visits to and use of the Site in order to improve the interest and ergonomics of the services;
• To adapt the presentation of the Site to the display preferences of the Terminal of the Person Concerned (language used, display resolution, operating system used, etc.);
• To memorise information relating to a form completed by the Person Concerned on the Site (registration or access to your account);

• Their advertising identifier linked to their Terminal's operating system;
• The IP address of their Terminal;
• Language preferences.
• Information on browsing and behaviour on the Site:
• Statistics on the consultation of the various pages of the Site;
• The complete URL path to, via and from the Site;
• Information concerning The Person Concerned (age or age bracket, gender, declared and/or presumed socio-professional category, presumed centres of interest, etc.) linked to his/her activity on the Internet and communicated by third parties (advertisers, advertising agencies, etc.).

Opposition to cookies

The present General Terms and Conditions of Sale of the company e-comeo OÜ (hereinafter "General Terms and Conditions of Sale") - whose complete contact details are available in the General Terms and Conditions of Use, accessible from the footer of the site.

(hereinafter "Cilanda") - are intended to define the rights and obligations of Cilanda and the Customer (hereinafter referred to as the "Customer") in connection with the sale of Products from the website Cilanda.com (hereinafter the "Website") published and operated by Cilanda.

The conditions of use of the Site and the free services accessible from it are defined in Cilanda's General Conditions of Use, available in the footer of the site.

The conditions of use of the paid services accessible from the Site are defined in Cilanda's General Terms of Service, accessible from the footer of the site.

Cilanda reserves the right to modify these General Terms and Conditions of Sale at any time. The Customer will be notified of any new version prior to the completion of the Order. Definitions

• Customer : designates any natural person, 18 years of age or older, contracting with Cilanda to purchase Products for personal use;
• General Terms and Conditions of Sale: refers to the present General Terms and Conditions of Sale;
• Privacy Policy: refers to the Customer's privacy and data protection policy implemented by Cilanda and accessible from the site footer, which forms an integral part of these General Terms and Conditions of Sale;
• Order: means the order(s) for Product(s) placed by the Customer with Cilanda on the Site and in accordance with the terms and conditions set out in these General Terms and Conditions of Sale;
• Personal Data: refers to the Customer's personal data collected and processed by Cilanda in connection with the Order, in accordance with the terms and conditions set out in the Privacy Policy;
• Withdrawal Form: refers to the form in Appendix 2 of these General Terms and Conditions of Sale, enabling the Customer to exercise his/her right to withdraw from the Order;

Product overview

Cilanda offers the Customer the opportunity to purchase the Product(s) of his/her choice offered on the Site.

Prior to placing an Order, the Customer may view the characteristics of the Product(s) he/she wishes to order directly on the Site.

Order terms and conditions

Order validity conditions

Orders placed through the Site may only be used for personal purposes, as declared and acknowledged by the Customer. In this respect, Cilanda reserves the right to limit the number of Orders placed, if too many would lead to the assumption that the Products are being used for commercial purposes.

These restrictions may apply to Orders placed via the same credit card, or using the same billing and/or shipping address.

The Customer agrees not to resell the Products Cilanda reserves the right to prohibit sales to any Customer who resells Products.

Ordering process

To place an Order, the Customer must go to the Site, purchase the Product(s) of his/her choice by clicking on the "Add to Basket" button and specifying the number of Products required.

On the "Shopping Cart" page of the Site, the Customer enters his/her delivery and billing address and expressly accepts the terms of these General Terms and Conditions of Sale by ticking the corresponding box, then proceeds to pay for the Order by credit card.

The Order placed by the Customer will only be definitive once the Customer has actually paid the amount of the Order.

Order confirmation by Cilanda.

All Orders placed by Customers on the Site are immediately confirmed in writing by Cilanda, by e-mail to the Customer.

An e-mail is also sent to the Customer to inform him/her of the dispatch of the Product(s) purchased.

Product availability

Cilanda undertakes to deliver the Products while stocks last.

In the event of unavailability of one of the Products, the Customer will be informed :

• either, when the Order is placed on the Site and the sale cannot be completed;
  or, after payment of the price, by e-mail, as soon as possible.
• Cilanda will refund the price of the unavailable Product(s) to the bank account used for the Order, within thirty (30) days of the notification sent to the Customer.

Prices and payment

The prices shown on the Site for each Product are inclusive of all taxes.

Payment can only be made by credit card (Visa, MasterCard) on the Site.

Payments by PayPal, American Express or other payment methods will not be accepted.

Payment is made on the Site via a secure banking platform managed by a third-party company. In this context, Cilanda has no access at any time to the customer's payment information and cannot be held responsible in the event of fraudulent use of the payment methods used.

Delivery

Terms of delivery

Each Product delivery is deemed to have taken place as soon as the parcel is made available to the Customer.

Without prejudice to the period available to the Customer under his right of withdrawal, we advise the Customer to check the parcel on arrival and make any reservations if necessary, or even refuse the parcel if it is likely to have been opened or if it bears obvious signs of deterioration. We advise you to send your reservations and claims to the carrier by registered letter with acknowledgement of receipt within three working days of receipt of the Product. The customer may send a copy of this registered letter with acknowledgement of receipt to Cilanda.

Delivery times

Products are delivered by post within the estimated delivery times indicated on the Site when the Order is placed.

In the event that the delivery date is exceeded by more than 30 days, the Customer may cancel the Order for the Product(s), by registered letter with acknowledgement of receipt or in writing on another durable medium, if, after having enjoined Cilanda to deliver the Product(s) within a reasonable additional period, Cilanda has not done so within such period.

The Order shall be deemed cancelled on the date of receipt by Cilanda of the letter or writing informing it of such cancellation, unless Cilanda has performed in the meantime.

In this case, Cilanda will reimburse the Customer, as soon as possible and at the latest within thirty (30) days of receipt of the aforementioned letter of formal notice, the price of the Product(s) covered by the Order, as well as the delivery charges invoiced to the Customer.

Delivery price

The cost of delivery is invoiced to the Customer according to the amount specified on the Site at the time of the Order.

Right of withdrawal

In accordance with the provisions of article L. 221-18 et seq. of the French Consumer Code, the Customer may exercise his right of withdrawal insofar as the nature of the Products purchased does not prevent him from doing so. The Customer may decide to withdraw from the Order, without having to give any reason, within a period of fourteen (14) clear days from receipt of the Product.

Customers wishing to exercise their right of withdrawal must inform Cilanda at the latest within the aforementioned fourteen (14) day period by sending the duly completed withdrawal form to Cilanda by e-mail or post.

In the event that several Products are sent to the Customer in separate shipments, making up a single Order, this withdrawal period shall run from receipt by the Customer of the last of the Products making up the Order.

As soon as possible after receipt by the Customer of the Cancellation Form, Cilanda will acknowledge receipt of the Cancellation Form by e-mail.

The Customer shall, without undue delay and, at the latest, within fourteen (14) days of communicating its decision to withdraw to Cilanda, return the Product(s) concerned to Cilanda at the postal address specified in the Cancellation Form and in accordance with the terms and conditions specified in the said Cancellation Form and in the information note attached thereto.

The cost of returning the Product(s) subject to the right of withdrawal shall be borne exclusively by the Customer.

The exercise of the right of withdrawal must be made subject to the good faith of the Customer, who undertakes in particular to return the Product(s) only in perfect condition (undamaged, undamaged, soiled, unsealed), in their original packaging accompanied by any accessories and documentation, which implies in particular that the Product(s) has (have) not been the subject of any use unsuitable for their return.

The returned Product(s) must also be accompanied by the invoice for the Order, so that Cilanda can identify the Order and the Customer concerned.

The Customer shall be liable if the Product reaches Cilanda damaged or in a condition that does not allow its resale or in a depreciated condition resulting from handling other than that necessary to establish its nature and/or characteristics.

In the event of receipt by Cilanda of Product(s) subject to the right of withdrawal that does not allow Cilanda to ensure reimbursement, Cilanda shall inform the Customer by e-mail and return the Product(s) concerned.

If the Customer exercises his right of withdrawal under the conditions defined in the present article, Cilanda will reimburse the Customer for the price of the Product(s) subject to the right of withdrawal, including delivery costs.

The Customer will be reimbursed by the same means of payment as that used by the Customer to purchase the Product(s), i.e. by transfer to the Customer's bank account associated with the credit card used for payment, which the Customer accepts without reservation, at the latest within thirty (30) days of receipt by Cilanda of the Product(s) subject to the right of withdrawal.

Legal and contractual warranties

Cilanda is liable for defects in the conformity of the Products under the terms of the Consumer Code and for hidden defects in the Products under the terms of the Civil Code.

When acting under the legal warranty of conformity, the Customer :

• has a period of two (2) years from delivery of the Product to take action,
• may choose between repair or replacement of the Product, subject to the cost conditions laid down in the French Consumer Code,
• is exempted from proving the existence of the lack of conformity of the good during the twenty-four (24) months following delivery of the Product.the legal guarantee of conformity applies independently of any commercial guarantee that may have been granted. 

The Customer may also decide to invoke the warranty against hidden defects in the Product as defined in the French Civil Code, in which case he may choose between rescission of the sale or a reduction in the sale price in accordance with the Civil Code.

Miscellaneous provisions

Correspondence - Proof

Unless otherwise specified in these General Terms and Conditions of Sale, correspondence between Cilanda and the Internet User is mainly carried out by e-mail.

Pursuant to articles 1366 et seq. of the French Civil Code, the Internet User acknowledges and accepts that the information delivered by Cilanda by e-mail is binding between him/her and Cilanda.

Elements such as the time of reception or transmission, as well as the quality of data received, will be deemed as proof by priority as they appear on the aforementioned media, or as they are authenticated by Cilanda's computerized procedures, unless the Customer provides written proof to the contrary.

The scope of proof of information provided by the Site is that of an original in the sense of a written paper document, signed by hand.

Complete Terms and Conditions

These General Terms and Conditions of Sale express the entirety of the obligations of Cilanda and the Customer with respect to their subject matter. The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to herein shall not be interpreted for the future as a waiver of the obligation in question.

Partial invalidity

In the event that one or more stipulations of these General Terms and Conditions of Sale should be considered null and void, deemed unwritten or declared as such in application of a law, a regulation or following a decision of a competent court having final authority, the other stipulations shall retain all their force and scope and remain fully applicable, unless the invalid stipulation(s) were of a substantial nature and their disappearance would call into question the contractual balance.

Titles

In the event of difficulties of interpretation between one of the headings appearing at the head of the clauses of the present General Terms and Conditions of Sale and one of the clauses, the headings will be declared non-existent.

Applicable law and settlement of disputes

These General Terms and Conditions of Sale are governed by French law.

In the event of any dispute arising in connection with these General Terms and Conditions of Sale, their interpretation and their consequences, or with the acts supplementing or modifying them, the Customer shall contact Cilanda in order to attempt to reach an amicable solution. Any complaint to Cilanda must be made in writing.

Failing amicable settlement, the Customer may choose :

• To have recourse to an amicable mediation solution within a maximum period of one (1) year from the date of the written complaint made by the Internet User to Cilanda by either (i) referring the matter to a mediator of his/her choice, or (ii) resorting to the online dispute resolution system accessible at the following address: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage, it being specified that the proposed mediation process shall not be a prerequisite for the Internet User to refer the matter to the competent courts.
• Bring his/her claim before the competent French courts.

Appendix 1: Information on exercising the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days.

The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession, where applicable, of the last good.

For the withdrawal period to be respected, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

Effects of withdrawal

In the event of your withdrawal from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen, where applicable, a delivery method other than the less expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will refund you using the same method of payment you used for the original transaction, unless you expressly agree to a different method; in any event, this refund will not incur any costs for you.

You must return the goods to us without undue delay, and in any event no later than fourteen days after you have informed us of your decision to withdraw from this contract. This deadline is deemed to have been met if you return the goods before the fourteen-day period has expired.

You must bear the direct cost of returning the goods.

You are only liable for the depreciation of the good resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the good.
